What Happens After an Immigration Judge Grants Asylum?

What USCIS says about post-order asylum documentation and the records an asylee should preserve after the decision becomes final.

When an immigration judge or the BIA grants asylum and the decision becomes administratively final, the next practical issue is obtaining documentation of the new status.

USCIS currently states that, in most cases, it will create and mail asylum documentation after the final order without requiring an in-person field-office visit.

What documentation may arrive

USCIS says a person granted asylum in EOIR proceedings should receive a Form I-94 with an asylum stamp after the decision becomes final.

USCIS asks people to wait at least 45 days after the order becomes administratively final before contacting the USCIS Contact Center about missing documentation.

Keep the final decision permanently

Save:

  • the immigration judge or BIA decision;
  • proof of when the decision became final;
  • post-order instructions;
  • the Form I-94 or other status documentation;
  • employment-authorization documents, if applicable; and
  • records of any later USCIS filings.

Make sure the government has the correct address

USCIS specifically warns that people who have moved after a final EOIR decision should update their address so that status documents are not mailed to an old location.
